1.1 Welcome to the website of Ir Melucha Real Estate (hereinafter: “the site”). The site holds a database of properties for sale and rent, focused on Jerusalem and the surrounding area, and provides brokerage, property advertising and property matching services for buyers and tenants.

1.2 Use of the site — including browsing properties, listing a property, registering a user account, signing up for alerts or making contact through one of the forms — constitutes full acceptance of these terms.

1.3 These terms are written in the masculine for convenience only, and apply equally to women and men.

1.4 These terms form a binding agreement between the site and the user. We recommend reading them in full before use.

2Definitions and parties

2.1 “the site” / “the site operator” / “the business” — Ir Melucha Real Estate, the owner and operator of the site.

2.2 “the user” — anyone who browses the site, registers on it, lists a property on it or uses its services.

2.3 “property” — an apartment, a housing unit, a commercial property or any real estate right presented on the site.

2.4 “property owner” — anyone who lists a property on the site, alone or through the business.

2.5 “track” — one of the service tracks listed on the tracks page.

3Services on the site

3.1 The site offers, among other things, the following services:

• Searching and browsing properties — a database of apartments for sale and rent, filtered by city, neighborhood, price, number of rooms and other features.
• List your apartment free — property owners can list a property on the open board, free of charge.
• Full brokerage service — professional support from the office team in advertising, filtering inquiries, holding viewings and negotiating through to closing.
• Matching system & CRM — matching properties to the search criteria the user has set.
• Alerts & phone alerts — voice alerts to your phone, a daily newsletter, and notifications about new properties and price changes.
• VIP listings — a closed area for properties kept private, access to which requires prior approval.
• My account — saving favorite apartments, saving searches, and turning alerts on or off.
• A board for agents and investors — an area for cooperation between licensed agents and the investor community.

3.2 The business may change, add or discontinue any service on the site, in whole or in part, at its discretion and subject to the law.

3.3 The scope of service, the way the property is exposed and the contact details displayed vary according to the track selected, as detailed on the tracks page.

4The site's status and brokerage activity

4.1 The business's brokerage activity is carried out in accordance withthe Real Estate Brokers Law, 5756–1996 and the regulations issued under it.

4.2 The business's broker license number: ___________.

4.3 Browsing the site or making an inquiry through it does not in itself create a brokerage relationship. Entitlement to a brokerage fee arises only when the conditions set by law are met, including the signing of Written brokerage engagement form as required by section 9 of the law.

4.4 The business is not a party to the transaction between the seller/landlord and the buyer/tenant, and bears no responsibility for its performance, its terms or its breach.

4.5 The site does not constitute legal, tax, appraisal or financial advice. We recommend consulting appropriate professionals before entering into a real estate transaction.

4.6 Some properties on the site are listed directly by their owners on the free listing track, with no brokerage involvement by the business. For those properties the business acts solely as an advertising platform.

5Agency fee

5.1 Listing a property and browsing properties are free of charge.

5.2 A brokerage fee will be charged only on a transaction actually closed as a result of a brokerage act by the business, in accordance with the Real Estate Brokers Law and a written engagement signed in advance with the client.

5.3 The brokerage fee, its payment date and its terms are set in a written engagement signed between the parties before the brokerage act is performed, and are not set on the site.

5.4 Nothing on the site or in these terms constitutes a commitment to any particular brokerage fee.

6Property listed by a user

6.1 A user who lists a property on the site declares and undertakes that:

• they are the property owner, their attorney, or otherwise lawfully authorized to list it.
• The details they provided about the property — including address, size, number of rooms, floor, condition, availability date and asking price — are true, accurate and up to date.
• The photographs they uploaded were taken at the property itself, and they hold the rights in them or have permission to use them.
• They will notify the business without delay of any material change, in particular a change of price or the property no longer being available.

6.2 The user bears full and sole responsibility for the content they published, and indemnifies the business for any damage, claim or expense caused to it by an incorrect, misleading or infringing listing.

6.3 The business may, at its sole discretion and without prior notice, refuse to list a property, edit the wording of an advertisement, remove a property from publication or remove photographs — including where a listing is suspected of being incorrect, misleading, offensive, duplicated or unlawful.

6.4 Listing a property on the site constitutes the advertiser's consent to the advertisement also being distributed through the business's other channels — newsletter, phone alerts, notice boards and print advertising — unless agreed otherwise in advance and in writing.

6.5 Do not list a property that does not exist, a property not intended for an actual transaction, or an advertisement intended only to collect inquiries.

7Accuracy of property information

7.1 The information shown on property cards is for initial impression only and is not a binding representation.

7.2 A significant part of the information comes from property owners, cooperating agents and external sources. There may be inaccuracies, errors or gaps between what is shown and the actual situation.

7.3 Prices, availability dates, property availability and property details may change at any time without prior notice. A property may be sold, rented or withdrawn from the market before the listing is updated.

7.4 Property photographs are illustrative. There may be differences between the photograph and the property itself, including because of camera angle, lighting, renovation or a change of furniture. Properties not yet photographed show the business's default image.

7.5 The property's position on the map is approximate and does not indicate its exact address.

7.6 It is the user's responsibility to verify independently, before entering into any agreement, the property's details, its legal and planning status, the registration of rights, debts, levies and its suitability for their needs.

8Registration and user account

8.1 Some services on the site — including saving favorite apartments, saved searches and the personal account area — require opening a user account.

8.2 The user undertakes to provide accurate and complete details on registration, and to update them as needed.

8.3 The user is responsible for keeping their login details confidential, and for every action taken through the account.

8.4 The business may block or cancel the account of a user who breached these terms, provided false details or misused the site's services.

8.5 Registration for the VIP area or the agents' board is subject to the business's prior approval, verification of the applicant's details and compliance with the track's terms.

9Alerts, calls and email

9.1 Registration for the alert system — phone alerts, the newsletter and notifications about new properties — is done with the user's explicit consent, in accordance with section 30A of the Communications Law (Telecommunications and Broadcasting), 5742–1982.

9.2 You may unsubscribe at any time, using the “unsubscribe” link at the bottom of every email, by turning the alert off in your account area, or by calling 050-4102397 directly.

9.3 The business makes an effort to send alerts in real time, but does not undertake that the system will be continuously available, nor as to the time of sending or the actual arrival of the message — including because of network faults, blocks by the mobile carrier or changes to the handset.

9.4 A delayed, unsent or unreceived alert shall not give the user any cause of action, including for a missed business opportunity.

10Paid services

10.1 As at the date these terms were updated, the services offered on the site — including listing a property, registration, phone alerts and the newsletter — Provided free of charge.

10.2 The business reserves the right to add paid services in future, such as a subscription, an extended advertising package or a premium service.

10.3 Any paid service offered in future will be presented to the user in advance, stating the total price (including VAT), the payment terms and the cancellation terms, and will require the user's explicit, separate approval before being charged.

10.4 Paid services are subject to the Consumer Protection Law, 5741–1981, and the Consumer Protection Regulations (Cancellation of a Transaction), 5771–2010, including the cancellation rights set out in them.

10.5 Nothing on the site constitutes a binding offer for a paid service until its terms are expressly presented.

11Intellectual property and content

11.1 All content on the site — text, design, graphics, logo, the structure of the property database, advertisement wording and code — is the intellectual property of the business, or of a third party that granted it a license to use.

11.2 The user may use the content for their personal needs only. The site's content may not be copied, reproduced, published, translated, sold or used commercially in any way without prior written approval.

11.3 Automated harvesting of property data is strictly prohibited from the site, including by robots, crawlers, scripts or scraping tools, and copying the database or parts of it to a competing board, site or service.

11.4 A user who uploads content to the site — including photographs and property descriptions — grants the business a non-exclusive, royalty-free license to use that content to advertise the property across all of the business's distribution channels.

11.5 The business may change, update or delete content on the site at any time, without prior notice.

12Limitation of liability

12.1 The site and its services are provided “as is” (AS IS), without any express or implied warranty as to accuracy, availability, completeness, continuity or fitness for the user's needs.

12.2 The business is not liable for direct or indirect damage, including lost opportunity, financial loss or distress, arising from use of the site, from reliance on information shown on it, or from an engagement formed as a result.

12.3 The business is not responsible for content published by users or by cooperating agents, and does not verify its accuracy before publication.

12.4 The business does not undertake that the site will be continuously available, and may take it down for maintenance or for any other reason.

12.5 Should any provision of this chapter be found void or unenforceable, the remaining provisions shall remain in force.

13Privacy and data protection

13.1 While using the site, personal information is collected — name, phone, email, search preferences and property details — in order to provide the service and make contact.

13.2 The information is held in secure systems belonging to the business and its service providers, using encrypted communication (SSL), access control and accepted information security procedures.

13.3 The business will not pass personal information to a third party except to provide the service, to advance a transaction the user requested, or where required by law.

14Links to external sites

14.1 The site may include links to external sites, including map services, social networks and analytics tools.

14.2 The business has no control over the content or privacy policies of those sites, and is not responsible for them.

14.3 Including a link is not a recommendation, and following it is the user's sole responsibility.

15Changes to these terms

15.1 The business may update these terms from time to time, at its sole discretion.

15.2 The binding version is the one published on the site at the time of use. Continued use of the site after an updated version is published constitutes acceptance of it.

16Jurisdiction

16.1 These terms, and anything arising from them, are governed solely by the laws of the State of Israel.

16.2 Exclusive jurisdiction over any dispute lies with the competent courts of the Jerusalem District.

17General

17.1 Section headings are for convenience only and are not used to interpret these terms.

17.2 Should any provision of these terms be declared void, the remaining provisions shall remain in force.

17.3 A waiver by the business of any of its rights in a particular case shall not be treated as a waiver of that right in other cases.
