1General

1.1 The site is operated and managed by Ir Melucha Real Estate (hereinafter: “the business”).

1.2 The site is intended for presenting properties for sale and rent, for owners to list their properties, and for providing brokerage, matching and guidance services in real estate transactions.

1.3 These terms of use are written in the masculine for convenience only, and apply equally to women and men.

1.4 Use of the site, its content and its services indicates the user's acceptance of these terms and their undertaking to abide by them.

1.5 These terms of use supplement Terms and conditions and Privacy policy. In any conflict between the documents, the site terms prevail.

2Accessibility

2.1 The site operates in accordance with Israeli Standard 5568 (formerly Standard 13) for web accessibility, and subject to the Equal Rights for Persons with Disabilities Law, 5758–1998.

2.2 The site supports accessibility features such as keyboard navigation, alternative text for images, readable contrast and a semantic heading structure.

3Permitted and prohibited use

3.1 The site may be used only for lawful purposes, for personal needs, and in accordance with these terms of use.

3.2 The user undertakes to refrain from the following:

• Using the site's content and property data for commercial purposes, without the business's prior written approval.
• Copying, distributing, publishing or broadcasting content without permission.
• Automatic data collection from the site — including by robots, crawlers, scripts or scraping tools — and copying the property database or parts of it to a competing board, site or service.
• Listing a property that does not exist, that the user is not authorized to list, or an advertisement whose details are wrong or misleading.
• Contacting property owners or other users for marketing, commercial offers or mailings unrelated to the property itself.
• Interfering with the site's operation or the servers running it, including attempting to bypass security measures or reach closed areas such as the VIP section without authorization.
• Using the site in a way that could harm the privacy of other users or of property owners.
• Providing false details when registering or filling in a form on the site.

3.3 The business reserves the right to block access to the site, block an IP address or close the account of a user who breached these terms — without prior notice and without derogating from any other remedy.

4User-uploaded content

4.1 A user who uploads a property or content to the site is fully and solely responsible for its accuracy, its legality and the rights in it.

4.2 Do not upload offensive or misleading content, content that infringes copyright, or photographs taken at a property without the owner's permission.

4.3 The business may edit, refuse to publish or remove any uploaded content, at its sole discretion.

4.4 Uploading content to the site grants the business a non-exclusive, royalty-free license to use it for advertising the property across the business's distribution channels — website, newsletter, phone alerts and print advertising.

5Liability and limitation of liability

5.1 The content on the site is provided “as is” (AS IS), and the business bears no responsibility for its accuracy, currency or completeness.

5.2 Property details shown on the site are for initial impression only. Prices, availability, move-in dates and specifications may change at any time without notice, and a property may be sold or rented before the listing is updated.

5.3 Property photographs are illustrative, and may differ from the property itself. The property's position on the map is approximate only.

5.4 It is the user's responsibility to independently verify the property's details, its legal and planning status and its suitability for their needs, before entering into any agreement.

5.5 The site does not constitute legal, tax, appraisal or financial advice.

5.6 The business is not liable for any damage, direct or indirect, caused to the user through use of the content, information or services on the site, including loss of a business opportunity.

5.7 The business does not undertake that the site or the alert and call-alert system will be continuously available and functioning, and may take them down for maintenance.

6Links to external sites

6.1 The site may include links to external sites, including map services and social networks.

6.2 The business has no control over the content of those sites, and is not responsible for the information or services provided there.

6.3 Including a link does not constitute a recommendation or approval of the linked site.

7Intellectual property and copyright

7.1 All copyright, trademarks, design, content, photographs, advertisement wording, the structure of the property database and the code belong solely to the business, unless stated otherwise.

7.2 The site's content may not be copied, reproduced, published, translated, sold or used commercially in any way without prior written approval.

7.3 The name “Ir Melucha”, the logo and the business's trademarks may not be used without permission.

8Privacy and information security

8.1 The business respects users' privacy and operates under an up-to-date privacy policy in accordance with the law.

8.2 Personal details provided on the site will be used solely to provide the service, and will not be passed to a third party without consent — except for suppliers essential to providing the service, or where required by law.

8.3 That said, the business cannot guarantee absolute immunity of the data against breaches or unauthorized access.

9Changes to the terms of use

9.1 The business reserves the right to update these terms of use from time to time, at its sole discretion.

9.2 Any change takes effect on publication on the site, and continued use of the site constitutes acceptance of those changes.

10Jurisdiction

10.1 These terms are governed solely by the laws of the State of Israel.

10.2 Exclusive jurisdiction over any matter arising from these terms lies with the competent courts of the Jerusalem District.
